Former US Attorney Finds Glaring Abuse of Power in Boasberg’s Latest Court Order in TdA Alien Enemies Act Case

A former US Attorney found a glaring abuse of power in Judge Boasberg’s latest court order in the Alien Enemies Act case.

Former US Attorney Jay Town pointed out that it appears Boasberg just appointed the ACLU as counsel for every single Tren de Aragua member in the United States.

On Wednesday evening lawyers for the ACLU representing Tren de Aragua gang members in the Alien Enemies Act case asked Judge Boasberg in DC to keep his case going by allowing them to file ‘habeas claims’ for gang members deported to El Salvador.

The ACLU asked Boasberg to grant them a TRO that forces the US government to provide 30 days notice for removal of any ‘class member’ AND the ACLU under the Alien Enemies Act.

“This Court continues to have jurisdiction over all class members’ claims that adequate notice is required under the Supreme Court’s ruling, the AEA, and due process—whether those individuals are in immigration custody, in criminal custody, or not detained,” the plaintiffs’ motion for TRO said.

“This Court is the proper venue for habeas petitions from class members detained in CECOT,” the ACLU argued.

On Thursday Judge Boasberg went along with the ACLU’s scheme and ordered the government to file a response to the plaintiffs’ motion for TRO by April 19.

Former Trump-appointed US Attorney for the Northern District of Alabama Jay Town said it appears Boasberg just appointed the ACLU as counsel for EVERY TdA member in the US regardless of whether they are in DC (Boasberg’s district) or not.

The ACLU said “class members” are in at least four different districts throughout the country.

“The “class” he’s referring to is unclear to me, but seems to be every TdA member in the U.S,” Jay Town said.

“If so, this is an arbitrary and capricious abuse of power,” he said.
